Appeal dismissed by an association against a wind farm project in Brittany

In March 2017, the Nantes administrative court of appeal rejected the opponents' appeals, thus overturning the judgment of the Rennes administrative court, which had annulled the building permits issued in February 2014 by the prefect of Morbihan.

The wind farm, carried by Les Moulins de Lohan, a subsidiary of the Canadian group Boralex, aims to build 16 wind turbines 185 m high and with a footprint of 16 ha, or 0,4% of the 3.800 ha of the forest, for a total perimeter of 331 ha and an installed capacity of 50 megawatts (MW).

In May 2019, the SPPEF announced the cassation seizure of the Council of State, which therefore did not prove it right.

"The appeal of the association Society for the protection of landscapes and aesthetics of France and others is rejected", according to the Council of State, in a decision that AFP was able to consult.

For the Council of State, "the administrative court of appeal (...) noted the fragile nature of Brittany's electricity supply, resulting from low local production covering only 8% of the region's needs ".

In addition, "the court noted that the company carrying the disputed project, after having considered several types of renewable energies, retained the forest of Lanouée because it allows the establishment of a wind farm at more than one kilometer of dwellings, a particularly rare situation in Brittany where one observes a sprawl of urbanization and a dispersed habitat (...) ".

But, according to the lawyer for the SPPEF, Sébastien Collet, "the necessary balance between the public interests relating to the production of electricity by means of renewable energy and the protection of the environment is therefore upset to the detriment of biodiversity. and our territories ".
