The world of co-ownership: what results for 2020
The health crisis that hit France in 2020 has pushed us to change many daily habits. Life in co-ownership has also undergone some adaptations. To see more clearly, Cotoit takes stock of this year and the changes related to the world of co-ownership.
The introduction of postal voting
Many changes have been made to the law of co-ownership by the ordinance of October 30, 2019, amending article 17-1 A of the law of July 10, 1965 to introduce the postal vote of co-owners at general meetings. The decree of July 2, 2020 then made it possible to fix the model postal voting form at AGMs, thus allowing all co-owners to vote by correspondence during general meetings. A very useful novelty to avoid the desertion of GAs in the current context.
Many reforms of the co-ownership
Other reforms also appeared in 2020, bringing some changes to the operations of condominiums:
- The ordinance of October 30, 2019 also simplified the possibility of changing the trustee, by making compulsory the competition of trustees every year (against every 3 years previously) and by putting in place a better framework for the transmission of documents. when there is a change of trustee.
- The management of small condominiums (less than 5 lots or average estimated budget of less than € 15 over 000 consecutive years) has also been simplified: they no longer have the obligation to constitute a union council, to follow an accounting in double part and to organize a general assembly (except for the vote of the provisional budget and the approval of the accounts).
- It is now possible to hold a GA by videoconference or by correspondence until April 1, 2021.
- The trustee contracts and terms of office of union council members which expired between October 29, 2020 and December 31, 2020 have been extended.
- The decree of July 2, 2020 also clarifies the standard contracts of trustees, by providing details on the role of the union council, whose power is reinforced, by changing the rules of competition, by regulating the termination of the contract. trustee and capping the dated statement.
All these new features, which arrived at the heart of the year, have made it possible to facilitate the management of condominiums and to partly adapt to the health context.
Better solidarity within condominiums
The complicated health context of 2020 and the implementation of lockdowns have helped promote solidarity within certain condominiums as well as understanding and mutual aid between neighbors.
New services available online
The year 2020 also greatly favored the implementation of online solutions and procedures. From now on, all the procedures are simplified and can be carried out remotely, such as video AGMs, access to all the documents of the co-ownership on a single platform, but also to better communicate with all the co-owners.
New features for condominiums in 2021
Easy access to the MaPrimeRénov 'system
Who says new year still says new things for the world of co-ownership.
In 2021, the MaPrimeRénov 'system was reformed: since January 11, 2021, all condominiums can now apply to finance part of their energy renovation work!
However, certain conditions must be respected:
- Have at least 75% of lots of main residences,
- Carry out renovation work that improves energy performance,
- Call on an RGE company (recognized guarantor of the environment) to carry out the work
The extension of the remote AGM
If some GAs have had to be postponed in recent months due to the health context, they must still take place before the deadline of January 31, 2021.
To help the co-owners to organize themselves, the holding of the AGM by videoconference is still authorized until April 1, 2021. As a reminder, voting by correspondence is also possible: co-owners who vote by correspondence are also allocated 15% votes from the syndicate of co-owners against 10% usually.
This should simplify decision-making within condominiums, despite the impossibility of holding general meetings in person.
