
This solution is not revolutionary; it already exists in other sectors of activity such as insurance, credit, banking and even tourism.
We should create a co-ownership mediator, responsible for amicably resolving any conflicts between co-ownership syndicates and their trustees.
A flexible mechanism for effective conflict resolution
Unlike other structural reforms that would require heavy legislation and a fairly long implementation time, the creation of a condominium mediator could be done by simple ministerial decree. This system would offer co-owners and trustees a rapid, accessible and extrajudicial avenue of recourse to resolve their disputes.
Today, in the absence of a dedicated body, conflicts often end up in court, with considerable costs and delays. An independent mediator would make it possible to find amicable solutions, speed up the processing of disputes and reduce the burden on the courts.
A balance between stakeholders
This mediator would not replace the union councils or professional trustees, but would play a facilitator role between the various stakeholders in the co-ownership. He should be contacted under the same conditions as other mediators, after both parties have already attempted to resolve a problem amicably. He could also be contacted for all matters of non-compliance with the co-ownership regulations.
A step towards a more peaceful co-ownership
The relationships between co-owners and their trustees are complex, and divergent interests can sometimes paralyze the management of buildings. The establishment of a mediator would provide a structuring framework to prevent blockages and facilitate communication.
At a time when we are seeking to modernise and simplify property management, such a system would constitute a pragmatic, quick to implement and effective development to guarantee better cohabitation and governance of co-owned buildings.
It is time to act to reconcile the stakeholders of the co-ownership with their trustee and to offer the co-owners, as well as our profession, a framework for constructive dialogue. A simple ministerial decree would be enough to transform the daily lives of 10 million French people in a lasting way.
