Measures concerning the return to work after a health problem are reinforced

These measures against "professional disintegration" are detailed in two decrees published in the Official Journal on Thursday in application of the occupational health law adopted this summer, which transposes a national interprofessional agreement.

According to an estimate by the General Inspectorate of Social Affairs (Igas), 1 to 2 million employees, or 5 to 10% of them, are in the short or medium term exposed to this risk of "professional disintegration".

While 100.000 people are dismissed each year for professional incapacity, the law "provides us with a toolbox which will allow us to better anticipate difficult situations", according to Mr. Pietraszewski.

Concretely, to further anticipate these risky situations, the law establishes "a liaison meeting" which will allow - with the employee's approval - an exchange after 30 days of stoppage with the employer and the occupational health service. to prepare for the return to work and any adaptations.

The law, which creates a mid-career medical visit, also provides that the pre-recovery visit takes place for stops of more than a month instead of three months today.

Finally, the law widens access to the "professional re-education agreement in the company" (CRPE), hitherto reserved for disabled workers, employees deemed unfit or at risk by an occupational doctor.

The latter will now be able to benefit from this system to train for up to 18 months in another profession within their original company or another, while retaining their employment contract and their remuneration.
