Quotas
Quotas for women will be introduced among senior executives and management bodies of companies with more than 1.000 employees, with a proportion of at least 30% of women by 2027, and 40% by 2030.
Starting in 2030, companies will have two more years to become compliant. Otherwise, a financial penalty is provided, capped at 1% of the company's payroll.
In a logic of "name and shame" (name and blame), these companies will also have to publish each year on the site of the Ministry of Labor the gender gaps. This obligation will apply two years after the publication of the law.
Professional equality indicators
The law requires companies with more than 50 employees to publish the results obtained for each of the indicators making up the professional equality index (pay gap between men and women, promotion gap, etc. .). As well as the progress objectives for each of these indicators.
Financial autonomy
Salary and individual social benefits must henceforth be paid into a bank account of which the employee is the holder or joint holder and can no longer be paid into the account of a third party. The goal is to prevent one member of the couple from taking control of the other's resources.
It was only since 1965 that women were allowed to open a bank account in their name and to work without the consent of their husbands.
Nurseries, training
The beneficiaries of the shared child education benefit, the vast majority of whom are women, will be guaranteed a right to training in order to encourage the subsequent resumption of a professional activity.
The places in crèches today reserved for children of parents engaged in a professional integration path will be accessible to single-parent families, 85% of whom are women.
Pregnancy and teleworking
To facilitate access to telework for women at the end of pregnancy, the company agreement or the telework charter must specify the conditions under which pregnant employees can benefit from this mode of work.
The parliamentarians gave up on enshrining in law a right to telework enforceable against the employer.
Funding
In order to increase the financing of women's entrepreneurship, the text includes "diversity objectives" in the support of the companies of the public bank BpiFrance. It sets a quota of 30% of members of each sex within Bpifrance's investment committees in order to fight against selection bias.
Higher Education
An "equality index" will be set up in higher education establishments and public research establishments, as well as in companies.
Admission juries for access to higher education must be made up of at least 30% of people of each sex.
The engineering titles commission, which accredits training courses providing engineering training, must ensure "the fair representation of women and men, the diversity of geographic and social origins, and the fight against all forms of discrimination. and taking into account the disability situation ".
