The draft decree on unemployment insurance sent to the social partners

The draft decree, of five articles, confirms the entry into force on July 1 of the modification of the calculation of the daily reference wage (SJR, base of the allowance), with a floor mechanism. According to the Ministry of Labor, it "draws the consequences" of the decision of the Council of State of November 25, 2020, which canceled the methods for calculating the SJR decided by decree in July 2019 on the grounds that they "carry (have) violation of "the principle of equality between beneficiaries.

The reform also created, as planned, a "bonus-malus" on the unemployment insurance contribution for companies in seven sectors that are large consumers of precarious contracts, with a first reference year which will begin on July 1 for application to contributions. from September 2022. The sectors most affected by the crisis will be excluded on a "temporary basis".

Still as announced, the decree provides for a "return to better fortune" clause on the opening and reloading of rights and the degression of allowances for high salaries.

The tightening of eligibility conditions will drop from 4 to 6 months when there is both a drop in 130.000 job seekers registered with Pôle Emploi in category A over "six consecutive months" and 2,7 million prior declarations. when hiring for more than one month out of four months.

The degressivity will take place in the 9th month from July 1, a period reduced to the 7th month according to the same indicators, "measured from April 1, 2021".

The draft decree specifies that in the event of strict confinement "in all metropolitan departments, for a period of at least four consecutive weeks" resulting "in an increase in the number of job seekers" in category A, the measurement of the change in the indicator can be "suspended".
