Thus, in 2005, with the creation of the status of “collaborating spouse”, the choice of a status became compulsory, thus allowing spouses to join the old-age scheme and guaranteeing them full and complete social protection.
In the government's action plan for self-employed workers and the social security financing law (LFSS) for 2022, the status of collaborating spouse has been reviewed with a view to "modernization and simplification".
If certain measures go in the right direction, such as the opening of the status to cohabitants, the CAPEB is mobilizing against the limitation to 5 years of the exercise of this status. A measure that came into force on January 1, 2022 against which CAPEB fought by presenting several amendments which unfortunately were not adopted.
But the CAPEB intends to bring this case again to the public authorities during this year, considering that the choice of status must be made taking into account above all what already binds the two spouses, that is to say the matrimonial regime, but also the financial capacity of companies to offer or not a status of salaried spouse.
A mobilization of craftswomen in Auvergne-Rhône-Alpes
To weigh in on the negotiations and improve the amendments tabled, the regional committee of craftswomen in Auvergne-Rhône-Alpes asked CAPEB AuRA to conduct a survey of member companies in the region.
- In 61% of the companies questioned, the spouse works within the company.
- The status of collaborating spouse is chosen by 37% of them.
- 69% of the companies surveyed say they are against limiting employee status to 5 years.
- Are appreciated: the flexibility of the status, the social protection that it offers when the company does not have the means to hire his or her spouse.
