This date of entry into force, postponed several times, could also be debated again because of the prolongation of the crisis, according to a trade unionist.

In mid-November, the ministry proposed amendments to its reform which were deemed insufficient by the unions.

The executive notably proposed to go back on the passage from 4 to 6 months of work to open up rights, but only for young people under 26 years old.

But the most contested point remains the methods of calculating the allowance, the heart of the reform.

The unions were able to welcome the decision of the Council of State which canceled the government's text on this point at the end of November because it “undermines” the principle of equality between beneficiaries.

The reform provided that the daily reference wage, base of the allowance, is no longer calculated on the total wages divided by the working days of the last 24 months but on this total divided by all the days, including no worked, of the period.

For the government, this modification aimed to correct a more favorable system, for the same number of working hours, to those who have split contracts compared to those who have continuous part-time work.

But this strongly penalized the "permittents", those often precarious who alternate unemployment and short contracts.

"Due to the rules adopted, the amount of the daily reference wage can now, for the same number of working hours, vary from simple to quadruple", criticizes the Council of State, seeing "a clearly disproportionate difference in treatment. ".

If it wants to maintain this point, the government will therefore have to propose a new, more relaxed version.

The employers will monitor the government's intentions on the establishment of a bonus-malus on the unemployment insurance contribution in seven sectors that are large consumers of short fixed-term contracts (accommodation and catering, agrifood, transport, plastics, etc.).

The Council of State also annulled this point but for a purely formal reason which had already been resolved. In mid-November, the government proposed to postpone its entry into force for one year (at the 2023 contribution), which the unions considered unacceptable.
