Justice validates the authorization imposed on renters of furnished tourist accommodation near Disneyland

The Melun administrative court rejected a request from the owners of furnished tourist accommodation in ten municipalities close to Disneyland Paris seeking to cancel the prior authorization required by the Val-d'Europe agglomeration community (Seine-et-Marne), a- we learned Thursday from the intercommunality.

The administrative judge, seized of a request for suspension of this obligation, maintained it until the examination of the merits of the case, on a date which has not yet been decided.

In his decision rendered on Wednesday and consulted by AFP, the judge considered that the deliberation of the ten municipalities of Val-d'Europe was neither "illegal" nor "disproportionate".

It notes in particular that the intercommunality had demonstrated "the existence of a shortage of housing intended for long-term rental justifying the establishment of a prior authorization system".

Contacted by AFP, the seasonal rental association did not react immediately.

This decision comes in the context of a legal battle between the owners of furnished tourist accommodation and the grouping of ten municipalities close to the Marne-la-Vallée amusement park.

In October 2022, the summary judge suspended a similar regulation taken by Val-d'Europe, ruling in favor of the owners, before new rules were put in place in December 2023.

According to the agglomeration, the number of tourist rentals more than doubled between 2020 and 2023 on its territory, going from 289 to 753.

The development of the rental of furnished tourist accommodation in France, possible for professionals as well as for individuals, has revealed tensions in certain cities and questions about their regulations.

On Wednesday, the Paris Administrative Court of Appeal ruled on a similar case, justifying the Paris municipality's refusal to authorize three Airbnbs due to the "risk of excessive noise pollution" for the neighborhood.
