The LPEC will also have to transpose into domestic law the Energy Efficiency Directive (EED) which provides, among other things, for the establishment of the principle of primacy of energy efficiency for all sectors and a step-by-step increase in the level of Binding annual energy savings obligation for each Member State, for the period 2021-2030.

An effort by the Government to offer more visibility to the sector through the sustainability of the Energy Savings Certificates system
The consultation announces in particular a publication of the decree modifying the level of obligation for the year 2025 at the end of the year 2023 and a publication of the decrees relating to the level of the obligation and the methods of execution of the 6th period at during the first semester of 2024.

This responds to our request to obtain more security for the building and energy renovation sector, which suffers from chronic regulatory instability. This calendar is unique. It will make it possible to sustainably secure the investments and activities of the sector. »
Another welcome step, the Government proposes to raise the obligation for 2025, the last year of the 5th period of the CEE system. This increase would correspond to an increase of 400 TWhc for the year 2025. This volume would include 70 TWhc of precarious bond. The overall CEE obligation over the 5th period would amount to 3.500 TWh cumac, including 1.200 TWh “precarious”. This development is supposed to serve as a springboard towards the rise in the obligation forecast for the 6th period.
Towards an improvement in the identification of sources of real energy savings
The Government wishes to strengthen the assessment of energy savings and deposits of the CEE system. This identification makes it possible to improve the efficiency of the CEE system, since only the operations which make it possible to obtain a significant energy gain can be valued, this avoids financing inefficient operations.
The Government even intends to change the system towards a mechanism based on an obligation of results. Today, the device is based on an obligation of means, the volume of ESC issued is decorrelated from the energy savings obtained. The evolution towards an obligation of results would make it possible to integrate the notion of real economy into a CEE operation. Tools for measuring energy consumption already exist and make it possible to effectively manage the savings made.
For Pierre-Marie Perrin: “This change in doctrine is unprecedented but testifies to the Government's awareness of measuring the effectiveness of the CEE system and ensuring the efficiency of the public energy renovation policy. It is also necessary to take advantage of this consultation to recall the absolute necessity of rebalancing aid for energy efficiency towards the sectors that consume the most energy. We must absolutely encourage the government to commit massive aid to the industry, transport, agriculture and tertiary sector, the only guarantee of our sovereignty and energy independence. »
