The ban on renting thermal strainers in condominiums from 2025 should soon be suspended

This text is in line with the government's desire to adjust the timetable of the Climate and Resilience law for co-ownerships, and the Ministry of Housing and Urban Renewal indicated to the press that it supports this proposed law.

The Climate and Resilience Act provides that energy-intensive housing classified as G in the energy performance diagnosis (DPE) will be prohibited from being rented from January 1, 2025. This will then be the turn of housing classified as F from 2028.

In detail, the Ensemble pour la République (ex-Renaissance) MP Bastien Marchive and the socialist MP Iñaki Echaniz propose that G-rated housing should not be removed from the rental market if work is underway to renovate them thermally and if there is a blockage within the co-ownership or on the part of the tenant.

This cross-party text aims to "provide flexibility" to co-ownerships, "while staying on course and on schedule and preserving the interests of tenants", assures Iñaki Echaniz, quoted in a press release.

The two deputies also provide for "the possibility for the judge to reduce the rent by the amount of energy charges as well as the exclusion of G+ rated housing, which is particularly energy-intensive, from this system" and which has already been prohibited from rental since January 2023.

A time limit on the suspension of the ban on renting energy sieves is provided for in one specific case: if thermal renovation work has been voted on at the general meeting of co-owners, the deadline for carrying it out is three years, the socialist group in the Assembly told AFP.

To prevent the absence of a vote at the AGM from leading to "a permanent circumvention" of the obligations to improve the energy performance of housing, it is proposed to integrate thermal and energy renovation measures into the multi-year work plan of the co-ownership.

According to the ministry's figures, taken up by the cross-party text, up to 250.000 housing units located in co-ownerships and classified G could be affected by the rental ban from January 1.

The deputies requested that their text be included on the agenda of the National Assembly "during December, for entry into force at the beginning of next year".

"The minister wants this proposed law to pass quickly through the legislative process," her entourage said.

In France, 4,8 million homes are classified F or G, including 1,5 million in the private rental sector, 0,4 million in social housing and 2,9 million inhabited by their owners, according to government estimates for 2023.
