The Order of Chartered Surveyors invites the Government to review its reform of land publicity

The Order of Chartered Surveyors invites the Minister of Justice to take advantage of this "failure" to modify the provisions of the next version of the ordinance in order to correct certain inconsistencies in the future reform.

The Order of Chartered Surveyors (OGE) has been advocating for several years for a modernization of the operation of land registration. This is why the profession was consulted in 2018 as part of the work of the commission responsible for its reform, as well as in 2022 through a survey conducted by the Directorate of Civil Affairs and the Seal.

The OGE requested in particular to have direct and automated access to land registry services to obtain data and information from property records more easily. In support of this request, the profession recalled that it is subject to the legal obligation to verify the identity of owners when carrying out land registry acts (Article 646 of the Civil Code).

If the provisions of the order of June 19, 2024 provide for extending this faculty to other professions, the OGE was surprised to learn that it was not concerned.

For Séverine Vernet, President of the Higher Council of the OGE: "The absence of an extension of this direct access to land registration services for chartered surveyors, in the same way as for other professions which are not subject to the same legal obligations in real estate matters, constitutes nonsense and discrimination. Granting us this access would also significantly reduce the workload of land registration service agents, and would contribute to the fluidity and shortening of timeframes for land registration operations."

The OGE asked the 1.874 expert surveyors to contact the Minister of Justice by letter so that this failed act would be an opportunity to modify the draft ordinance in order to guarantee the coherence and efficiency of the new land registration system.
