Assembly votes to create database to record abandoned property

This bill, defended by MoDem MP Louise Morel and supported by the government, tackles the indefinite joint inheritances, these assets often blocked for years due to conflicts between heirs. It was adopted shortly before midnight by 55 votes for to 1.

The creation of this database on abandoned properties aims to enable local elected officials to better identify the legal situation of an abandoned or dilapidated property in the territory of their municipality, and therefore to take appropriate measures.

In addition to this measure, the deputies approved a provision inspired by the Letchimy law, a text voted in 2018 to facilitate inheritances overseas. This provides for authorizing individuals holding more than half of the rights (compared to 2/3 currently) to initiate the sale and sharing of real estate.

The text also establishes a five-year experiment with a system inspired by the local law of Alsace-Moselle which relaxes the procedure for judicial sharing, by making it rely more on the notary than the judge.

To be ratified, the text, defended by the MoDem within the framework of its parliamentary niche, the annual day reserved for the texts of its group, will have to continue its examination in the Senate, where it is not yet included in the agenda.
